By accessing or using the Site, creating an account, completing a health assessment, or enrolling in any program offered through Premier Element Group, you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, our HIPAA Notice of Privacy Practices, and any additional terms applicable to specific programs.

Our telehealth platform is powered by Bask Health, a HIPAA-compliant telehealth technology provider. Prescription fulfillment is handled by VialsRX, a state-licensed 503A compounding pharmacy located at 6220 Westpark Dr, Houston, TX 77057. Services are available in all 50 US states through affiliated medical providers and pharmacy partners operating in accordance with applicable state licensure requirements.
Premier Element Group is a management services organization, not a medical practice, hospital, or licensed healthcare provider. We do not provide medical advice, diagnoses, or treatment. Clinical care is provided exclusively by independent licensed healthcare providers affiliated with Arora Health & Aesthetics, LLC, who exercise their independent professional judgment in all clinical decisions.
Nothing on the Site or in any communication from Premier Element Group constitutes medical advice or establishes a physician-patient relationship. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. All clinical services, including the review of health assessments and the issuance of prescriptions, are performed by licensed independent healthcare providers affiliated with Arora Health & Aesthetics, LLC. These providers are independent contractors and are not employees or agents of Premier Element Group.
Premier Element Group does not direct, control, or supervise the clinical judgment of affiliated providers. All treatment decisions, including whether to prescribe a medication and at what dosage, are made solely by the licensed provider based on their independent medical evaluation of your submitted health information.
Premier Element Group makes no representations or warranties regarding the clinical outcomes of treatment recommended or prescribed by affiliated providers.
Compounded medications available through our pharmacy partners are not FDA-approved. They are prepared by a state-licensed compounding pharmacy operating under Section 503A of the Federal Food, Drug, and Cosmetic Act, pursuant to a valid patient-specific prescription issued by a licensed provider.
Compounded medications are not the same as, and are not generic equivalents of, any FDA-approved brand-name medication. They have not been evaluated by the FDA for safety, efficacy, or quality. Individual results vary and are not guaranteed.
You acknowledge that you have been informed of the compounded nature of the medication prior to enrollment and consent to receiving compounded preparations as part of your program.

You agree not to use the Site or services for any unlawful purpose or in any manner inconsistent with these Terms.
Programs are offered on a direct-pay, month-to-month subscription basis. No insurance is required or accepted. By enrolling, you authorize Premier Element Group to charge your payment method on file for the applicable program fee at each renewal interval.
You are responsible for maintaining accurate and current payment information. Failed payments may result in a suspension of program access until the outstanding balance is resolved.
Our Refund & Cancellation Policy governs all cancellation and refund requests and is incorporated into these Terms by reference. Please review it in full at premierelementgroup.com/refund-policy.html prior to enrolling.
In summary: orders cannot be canceled once placed, and all charges are final once a prescription has been transmitted to the pharmacy. A refund may be issued only if a licensed provider declines to prescribe treatment following review of your health assessment.
We are committed to protecting the privacy and security of your personal and health information. Our collection, use, and disclosure of your information is governed by our Privacy Policy and, with respect to Protected Health Information ("PHI"), our HIPAA Notice of Privacy Practices.
Our telehealth platform operates within a HIPAA-compliant infrastructure maintained by Bask Health under a signed Business Associate Agreement ("BAA") with Premier Element Group LLC. We do not sell your personal or health information.

All content on the Site — including text, graphics, logos, images, program materials, and software — is the exclusive property of Premier Element Group LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PREMIER ELEMENT GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.
You waive any objection to the exercise of personal jurisdiction by, or the venue of, such courts. Nothing in this section limits our right to seek injunctive or other equitable relief in any court of competent jurisdiction.
